BOROUGH OF RUTHERFORD
County of Bergen RESOLUTION
WHEREAS, the New Jersey Department of Transportation (NJDOT) proposes to reconstruct and improve New Jersey State Highway Route 3 within the Borough of Rutherford from the Passaic River Bridge to its interchange with New Jersey State Highway Route 17, said work to include the replacement of the Passaic River Bridge with improvements extending west to Main Avenue in the City of Clifton; and
WHEREAS, the NJDOT makes reference to the project as "Route 3 at the Passaic River Crossing" (Project); and
WHEREAS, the NJDOT has conducted a comprehensive community outreach effort during the preliminary design phase of this project, which included several community liaison meetings and public information centers; and
WHEREAS, federal highway funding has become available for the construction of noise walls as part of the project and the NJDOT conducted a public informati on center to educate residents about noise walls and questionnaires were made available to residents of the Borough; and
WHEREAS, the responses received to date indicated the residents support for the construction of noise walls as part of the project.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Rutherford that it shall support the project, said support being contingent on the following:
1. The approved Rutherford Streetscape Improvements shall be installed on all overpasses over Route 3 including the Park Avenue, Ridge Road and Orient Way overpasses. These improvements include concrete curb, colored concrete sidewalk with London scoring pattern, brick paver strip and decorative lighting standards. Said improvements are to be installed by NJDOT’s contractor at NJDOT’s expense during the construction phase of the project.
2. The exterior of the overpass structures which cross the improved Route 3 shall incorporate decorative architectural details which complement the style of the Rutherford streetscape, utilizing context sensitive design practices.
3. The exterior of the new Passaic River Bridge shall be constructed in a decorative manne r, which matches the style of the bridge carrying Union Avenue over the Passaic River.
4. On-street and Off-street drainage problems being experienced by the residents of Prebble Place should be adequately addressed by NJDOT during the construction of the new cul-de-sac portion of that road. The removal of the south end of Prebble Place, which is proposed to accommodate a new highway exit ramp, will create a hardship for the municipality relative to addressing drainage issues in this area.
5. Upgraded highway signage must meet with the approval of the Borough of Rutherford. Current signage is inadequate to direct motorists to various locations within the Borough.
6. It is recognized that several existing sanitary sewer lines crossing beneath Route 3 will be removed to make way for the proposed improvements. The remaining crossings must be upgraded and preserved to insure adequate function of the system
7. &nb sp; In order to accommodate the construction of the upgraded Highway, new sanitary sewer lines and storm sewer lines must be constructed within Marginal Road. Marginal Road shall be reconstructed from curb to curb to eliminate any utility trenches. In addition, any and all curb and sidewalk damaged during construction shall be replaced. Finally, handicap ramps shall be provided at all Marginal Road Intersections within the scope of the project area.
8. Dry hydrants and/or stand pipes shall be provided in various locations due to the difference in elevation between Marginal Road, Rutherford Avenue and the propose d Route 3. Said fixtures shall be located near fire hydrants on the adjacent roadways and shall provide direct access for firefighters who will need to respond to incidents on the highway. In locations where the highway is level with adjacent roadways, access portals in the noise walls shall be provided for fire line access. All said appurtenances shall meet the approval of the Rutherford Fire Official.
9. In the event that Rutherford Police Officers are required for maintenance and protection of traffic on local streets during the construction phase of the project, an agreement must be in place, which insures compensation to the Borough for the costs of the require d police services. Said agreement shall address situations where police services will be rendered by Rutherford officers and compensation rates for the required services.
10. The NJDOT shall address the sound wall construction and materials with the Borough of Rutherford. Based on responses from the residents, there is in an interest in the use of at least one level of acrylic panels at the top of the noise walls to allow sunlight to pass through. The specific details of the noise wall design are to be worked out between members of the project team and Rutherford Borough officials.
11. The project team shall continue the practice of regular meetings with the community liaison committee and Borough officials throughout the final design and construction phases of the project in an effort to keep the community informed about the project.
BE IT FURTHER RESOLVED, that the Governing Body, based on the responses received by the residents of the Borough of Rutherford, hereby endorses the design and construction of noise walls, with the understanding that the wall materials will be selected during the final design process and the walls will be adequately maintained at the sole expense of NJDOT.
